1. Master Terms of Service
These Master Terms of Service ("Terms") operate as a binding legal agreement between the Entity activating the SmartStore HQ account ("Customer", "You") and SmartStore HQ ("Company") governing access to the Enterprise Business OS (EBOS) and its sub-systems (POS, CRM, AI Employees).
A) Tenant & Org Node Provisioning
Upon account activation, the Company shall provision a dedicated PostgreSQL software tenant ("Workspace"). Customer is granted non-exclusive rights to create Org Nodes (Branches, Warehouses, Cash Counters) and access the platform during the active Subscription Term.
B) Role-Based Access Controls (RBAC)
Customer retains strict accountability for defining internal IAM permission boundaries, provisioning credentials to Employees (Cashiers, Managers), securing authentication, and managing offboarding. SmartStore HQ is not liable for data breaches born from misconfigured organizational roles by the Owner.
2. Commercial Privacy & Data Sovereignty
Your business intelligence is strictly yours. SmartStore HQ guarantees absolute operational sovereignty over customer data stored in our Neon.tech PostgreSQL databases.
A) DATA OWNERSHIP GUARANTEE
The Customer retains 100% unconditional ownership over all receipts, SKUs, inventory batches (FEFO), CRM WhatsApp leads, financial ledgers, staff shift logs, and branch telemetry inputted into the platform.
B) ZERO DATA MONETIZATION PACT
SmartStore HQ strictly never sells, rents, analyzes, or monetizes customer transaction records or end-consumer chats to external advertisers, AI trainers, or market makers. Your data is isolated at the tenant level.
3. AI Employees & Meta Webhooks Use
SmartStore HQ integrates advanced Gemini AI LLMs and Meta Graph APIs (WhatsApp, Instagram, Messenger) for unified inbox and automated sales.
Meta Commerce Policies
When utilizing the SmartStore HQ WhatsApp/Messenger integrations, you must strictly comply with the WhatsApp Commerce Policy. Sending unsolicited spam, prohibited items (drugs, weapons), or violating messaging window rules will result in your Meta Webhook being permanently disconnected by Facebook. SmartStore HQ is not responsible for bans issued by Meta.
AI Generation Liability
While our AI Employees are programmed to follow your custom multilingual persona and product catalogs, AI can occasionally generate unexpected responses (hallucinations). You agree to monitor the AI Draft Orders and chats in the Unified Inbox. SmartStore HQ is not financially liable for incorrect pricing quoted by the AI to a customer.
4. Infrastructure & Render SLA
SmartStore HQ's CQRS backend is hosted on enterprise cloud environments (Render, Neon). We back our infrastructure with strict uptime SLAs.
5. Data Portability & Offboarding
We never hold your data hostage. Upon account termination, you retain absolute export rights without administrative barriers.
A) Full Data Portability
Enterprise administrators can execute full JSON/CSV exports of all core ledgers, inventory tables, and receipts during an active subscription at any time without incurring data extraction fees.
B) Immediate 30-Day Purge
Upon confirmed account cancellation, all tenant storage partitions are disabled. Hard deletion procedures execute permanently across active Neon databases and backups 30 days post-termination.
